摘要
《行政诉讼法》实施中的问题主要是 :行政诉讼受案量少 ,司法执行案量大而难 ,行政诉讼撤诉率过高。法律本身的主要问题是 :诉讼主体不明确 ,受案范围过窄 ,诉讼管辖不合理 ,判决种类不齐全。必须对现行行政诉讼制度及相关因素进行改革和完善。
The Act of Administrative Lawsuit'have been implement for more than 10 years.The main problems in practice are,the quantity of administrative is less, the quantity of judicial implementing lawsuit is more,the percent of withdrawing prosecution is high. The main problems in legislation are,the subject of proccess isn't undoubtedly,the range of accepting lawsuit is narrow,the jurisdiction isn't proper,the judging kinds isn't complete.
