摘要
刑法 30 6条第 1款规定的“辩护人、诉讼代理人妨害证据罪”的设置受到了法学界的广泛批评。有必要对该罪名存在的一些缺陷进行客观分析 ,并从立法完善与司法适用两个方面提出解决意见。
The defender's or the legal representative's 'crime of impairing testifying' stipulated in Article 1, Provision 306 of the Criminal Law has been widely criticized by the academic circles of law. It is necessary to make an objective analysis of the crime's defects. The author also suggests solutions to the problem from the point of legality perfection and jurisdiction applicability.
