摘要
文章从法与经济学当中提炼出一个典型的进化理论,使之适用于三个相关概念,其一来自混沌理论,其二来自路径依赖理论,其三来自现代进化理论。文章认为,将混沌理论、路径依赖和现代进化理论与典型的进化论模型结合起来会更有利于理解法律与经济制度的产生和存续。
This paper abstracts a typical evolutionist model from law and economics and makes it suit the three related conceptions: one is from the chaos theory;one is from the approach dependent theory; and one is from the modern evolution theory. This paper deems that by the combination of the chaos theory, the approach dependent theory, and the modern evolution theory, the typical evolutionist model will does good to the better understanding of the emergence, the existence, and the development of law and economic systems.
