刑法理论界和实务界对有组织犯罪的概念理解不一,在一定程度上导致了司法的偏差。黑社会犯罪与黑社会性质组织犯罪是两个不同的概念,对后者的认定应严格依照刑法的规定,不过在解释上应当予以适当的扩张。文章还从刑事立法与司法的角度探讨了如何防范黑社会性质组织犯罪。

There are still different ideas about the definition of organized crime. This article holds that organized crime is different from organization in nature of criminal syndicate, whose connotation must be extended in legal interpretation. This article also discusses crime prevention from the angle of criminal law and judicial affairs.
