论剥夺政治权利刑的完善

On Perfection of Punishment of Deprival of Political Rights

剥夺政治权利作为一种资格刑,不仅内容存在诸多不妥当之处,且该资格刑刑名和其实际内容不仅不相符合,政治色彩也太浓,影响了其应有价值的发挥。因此,应对现行刑法典中规定的剥夺政治权利的资格刑刑名和内容加以改造。本文以为,剥夺政治权利改称剥夺公权后其内容应完善为:剥夺选举权和被选举权;剥夺担任公职的权利二类。对于剥夺政治权利改称剥夺公权后其适用对象应完善为针对危害国家安全的犯罪分子和被判处死刑、无期徒刑的犯罪分子,而对于严重破坏社会秩序的犯罪分子,作者认为应限定为被判处十年以上有期徒刑的犯罪分子。

As one kind of the punishment against qualification, there is quite a lot of inappropriation in the punishment of deprival of political rights,and its name falls short of the reality,has too dense political tint,all of which lowers its value.Therefore,the name and content of punishment of deprival of political rights should be perfected and stipulated in the crime law.
