刑罚与教育的关系,刑罚的教育含量,教育政策占刑事政策的比重,是法制文明程度的重要标志之一。从专制国(政治刑法、报复刑)到法治国(市民刑法、报应与功利刑),再到文化国(政策刑法、教育刑),惩罚与教育,体现了此消彼长、螺旋式上升的辨证关系。法治国度面对文化国度的教育刑,“困惑”是必然的,“启示”是当然的。

From autocratic states to law - states, and to cultual ones, the relationship between penalty and education indicates the dialectical law as one falling and the other rising. Facing the educational penalty of cultural states, the perplexity is inevitable and the enlightenment is without doubt for law - states.
