警察权的行使与公民权的保障是一个矛盾统一体。警察权的行使与扩张必然导致公民权的缩小,公民权的保障与张扬又势必形成对警察权的限制。如何协调和平衡二者之间的矛盾,实现警察权行使与公民权保障的统一,是立法者和执法者都难以回避的问题。公共管理理论为我们化解警察权与公民权的冲突、寻求警察权和公民权的平衡提供了一个新的分析框架。

It is a unity of opposites between the exercise of police power and the protection of civil rights.The civil rights will inevitably be reduced with the expansion of police power;on the contrary,the police power will be restricted with the expansion of civil rights.How to balance the contradiction between police power and civil rights is an unavoidable issue for legislators and law-executors.Public administration can provide a new analytical framework to resolve the conflict between police power and civil rights,and balance the two.
