高校学生人身安全事故预防机制构建之设想

The Assumption Of Constructing Prevention Mechanism Of College Students' Personal Safety Accidents

高校学生是国家发展的希望所在,其人身安全保障重在预防。这种事前预防机制的构建包括国家立法和高校内部管理制度建设两个层面,虽然当前我国也出台了《中华人民共和国侵权责任法》,但是对于高校学生这一特殊群体而言,具有一定的抽象性和概括性,不能适应当前高校学生安全保障的客观需要。在制度建设方面,实践中高校虽然也积累了较好的管理经验,但是这些制度往往需要与相关立法相结合才能取得较好的效果。文章从对现有立法和相关制度的角度出发,对高校学生人身意外伤害事故预防机制进行多维考虑,力求找到一个切实可行的预防机制,以保障高校学生在校的人身安全。

College students are the hope of our country's development, and the focal point of ensuring their personal safety is prevention. The construction of prevention mechanism beforehand contains two aspects: national legislation and college's internal administration system. Although nowadays Tort Liability Law Of The People's Republic Of China has been issued, there's certain abstractness and generality for such a special group, college students, so it can't meet the objective need of current college students' insurance. Concerning system construction, although colleges have accumulated better administration experience in practice, these systems often need to be combined with relative legislation to get better effects. This paper sets its hand to current legislation and relative systems, and presents multidimensional thinking of prevention mechanism of college students' unexpected personal injury accidents in order to find a practical prevention mechanism to ensure personal safety of college students at school.
