依法治校与教授治学相向而行——大学治理结构的国际比较及其启示

摘要 本文从历时性视角分析欧美大学学术自治、教授治校等演变历程和法治规则建构。现代大学危机在于行政权力不断膨胀,学术力量式微,现代大学治理结构变革必须基于大学的本质(学术)和现代社会治理的基础(法治)相融合的路径,厘清教授治学和依法治校之耦合点和共生机理。只有彰显大学组织本质属性的'法治',才具有实质意义,教授治学才能真正实现。 The paper analyzes the historical evolution of academic autonomy and professor’s academic governance in European and American universities.Modern universities face the expandation of administrative power and the weakening of academic power.The reform of modern university governance structure must base on the integration of academic essence of universities and rule of law,clarify the coupling point between professors’ academic governance and administering college by law.In fact,the realization of professors’ academic governance is inseparable from rule of law which highlights the academic essence of universities.
