摘要
在'县管校聘'试点过程中,教师聘用合同的适用逐渐暴露出一些理论与实践问题。其中,对合同适用法律依据缺失的情况,应对相应的法律规范进行完善;对法律关系竞合的情况,除进行相应制度设计方面的调整外,还应注重对相关当事人合法权益的保障;在适用教师派遣协议的过程中,应注意教育教学活动和教师身份的特殊性,科学、合理适用。
In the experimental process of "county manage and school employ",some theoretical and practical issues in the application of teacher’s employment contract was gradually revealed.The relevant legal norms should be improved.We should protect the legitimate rights and interests of relevant parties.On the application of teacher’s dispatch agreement,we should pay attention to the particularity of educational activities and teachers’ identity and use it scientifically and rationally.
