中小学法治教育的价值偏差与现实选择

Deviation and Choice: Value Orientation of Legal Education in Primary and Middle Schools

摘要 党的十八届四中全会提出要把法治教育纳入国民教育体系,从青少年抓起,在中小学设置法治知识课程。中小学承担着对学生进行法治启蒙的任务,法治教育价值取向的偏差必然会影响法治教育的实施效果。中小学法治教育应确立以从'法制'到'法治'转变为主线的价值取向,注重从'法律知识传授'到'法治意识培养';从'消极被动学法'到'积极主动尊法、学法、守法、用法';从要求'个人守法'到'国家守法'。 In the fourth Plenary Session of the 18th CPC Central Committee, it was proposed that legal education should be incorporated in the national education system as a required course, targeting at pupils in primary and middle schools. Such a task to foster legal awareness among students determines that any deviation of the value orientation in legal education will inevitably affect its desired effects in implementation. Therefore, value orientation of legal education in primary and middle schools should shift its attention from just rules to rule-of-law mindset, from mere knowledge to legal awareness development, from pupils' passive acceptance to active participation in respecting, learning, observing and using laws, from individual observance to all observance of laws.
