论台湾警察法的发展

On Development of Police Law of Taiwan

台湾警察法分广义警察法与狭义警察法,警察法学研究侧重的是狭义警察法即警察行政法。《社会秩序维护法》与《警察职权行使法》是台湾警察法体系中两部重要的法律,其制定、发展的过程充分体现了台湾警察法发展的趋向和途径。警察法的核心内容是警察权,即平衡公民自由与社会秩序之间的关系。公众监督、司法解释与学者参与则是推动台湾警察法发展的动力。

Taiwan police laws consist of one in a broad sense and the other in a narrow sense. Research of police laws focuses on the one in the narrow sense, namely, police administration law. There are two main important laws in the system of police legal systems: Social Order Maintenance Law and Police Enforcement law. Their establishment and development fully embody the trend and the path of police laws in Taiwan. The core contents of police laws are the rights of police, i.e. the equilibrium between the civil liberties and the social order. The public surveillance, judicial explanation and scholars' participate are the impetus to push forward the development of police laws in Taiwan.
