农村集体土地所有权性质及其变革路径探讨

On Feature of Village Collective Landholding Property and Its Changing Paths

我国农村集体土地所有权的性质应当属于一种新型的总有权,新型总有权学说与我国农村集体土地所有权的实际比较符合。但我国集体土地所有权存在社会保障制度的缺失以及所有权主体的物权法虚位的缺陷。应当变革现行的集体土地登记制度和承包经营权方式,完善土地用益物权,以及所有土地统一为国家所有,即国家为土地所有权的唯一主体,以此来完善我国的农村集体土地所有权制度。

The property of the collective land ownership of village should belong to a new processing right. The theory of new processing right fits the factual status of collective land ownership of village. But the collective land ownership has the imperfection of lacking of social guarantee system and having the blemish of the property law of the ownership corpus. We should change current register system of collective lands and Family - Contract -Management system ways, perfect the land using benefit property right, and nationalize all lands, i.e. the state is the only corpus of landholding corpus, thus in order to perfect the collective land ownership system of village.
