摘要
劳动争议是社会生活中最普遍的一类纠纷,为了切实维护当事人的合法权益,通过对目前劳动争议处理制度中存在的突出问题进行分析,提出或裁或审,明确仲裁申诉期的中止、中断和延长,完善监督机制,部分案件举证责任倒置等一系列制度设计。
Labor dispute is a common issue in social life.To vindicate properly the litigant's legal right and interest,this paper makes some designs on the system by analyzing some existing outstanding issues in the current Handling-System of labor dispute.These system designs mainly are: making a choice between adjudications and judgment,making sure when to cease,interrupt or lengthen the arbitration period,perfecting the supervising mechanism,inverting the proof-providing duty,etc.
