我国检察机关领导体制改革之探析

On the Reformation of States Procuratorial Organ Leading System

建国50多年以来,我国检察机关的领导体制几经反复和变化,目前的双重领导体制对检察权的行使、国家法制的统一与检察队伍素质的提高等仍存在不少掣肘。我们认为,构建我国检察机关的领导体制,既要考虑我国的政治体制,也应顾及检察机关自身的性质与法律地位,还需借鉴国外的成功实践经验。基此,我国检察机关应实行垂直领导体制。

It is 50 years after China has been established.Since then,the leading system of the states procuratorial organ has changed back-and-forth for times.But the out-of-date two-layer leading sys- tem is still as a hindrance in performing the prosecute power,until the state's law institutions and enhanc- ing the ability of the judical staff.In our opinion,To build the leading system of procuratorial organ,We should considerate China's political system,The essence and legal position of procuratorial organ,and con- sult the succeeded legal experience of foreign country's.Therefore,Our state's procuratorial organ should im- plement vertical leading system.
