我国刑事证人不出庭作证行为的理性分析

证人出庭问题一直困扰着我国司法改革和实践,时至今日,证人出庭难的困境依然未得到有效缓解。究其原因,主要是因为对证人不出庭行为本身缺乏必要的分析,没有认识到证人不出庭行为存在的合理性和价值性,从而对证人出庭行为认识不全面,导致解决措施实效性降低。而通过对证人不出庭行为的合理性研究,能够促成研究视角的转换、提高全面思考的意识和增强措施的实效性。

The problem that few Witnesses appear in court is alwarys stifling our judicial reforms and practice,up to now,the situation in has not been imroved effectively.It is because of the lack of necessany analysis on the behavior itself of witness absence in court and the an thorityts failing to realize the rationality and the value of it.So that there is a lack of comprehensive understanding and reduces the effectiveness of solution measures.Instead,through researching the rational behavior of witness appearing in court,we can facilitate in transformating the verspective of research,enhance the comprehensive reflecting consciousness and enhance measure effectiveness.
