中国与国际法的协同进化

Co-Evolution of China and International Law

自鸦片战争170余年以来,中国与国际法的接触改变了中国社会的格局与心态,也改变了国际法的体系与结构。中国从一个经济自足、文化封闭的状态起步,在国际法的压力和促动之下,发展工业、变革思想、践行法制,开启了步入现代性的历程。与此同时,中国对国际法日渐熟悉并参与一系列的国际法活动,成为国际舞台上逐渐受重视的行为体。中国最初遭遇国际法,深化和印证了国际法的西方主导性和实质的不公正性,但对于国际法的应用也为国际法实施的平等注入了新的元素。中国与国际法的积极互动引致了二者之间的协同进化。认知并运用国际法是中国走向国际社会的重要步伐,在此过程中产生了一些新的问题,使国际法不断面临并应对新的挑战,也为国际法自身的健全和完善提供了很多新的智慧、新的力量。

For more than 170 years,the influence of China and international law has not been a one-way process, but a process of mutual construction and co-evolution. The contact between the two changed the pattern and mentality of Chinese society as well as the system and structure of international law. China’s initial contacts with international law have deepened and confirmed the Western dominance and substantive unfairness of international law,and China’s application of international law has also injected new elements into the equality of international law. China’s participation in the process of enacting and implementing international law is an important step for China to move toward the international community. At the same time,it has also raised some new issues,making international law face new challenges and responding to new challenges,and providing many new power for the improvement and perfection of international law. Starting from a state of economic self-sufficiency and cultural closure,China has developed a process of modernity under the pressure and urging of international law to develop industry,change ideas,and practice the legal system. At the same time,the increasing familiarity with international law and participation in a series of national legislative activities has become an increasingly valued actor in the international arena.
