中国大陆(内地)的电信网络诈骗问题愈演愈烈,"徐玉玉"案引起了社会的广泛关注,严厉打击电信网络诈骗成为共识。关于电信网络诈骗的定罪问题,因非法获取财物是犯罪目的,故通常首先涉嫌构成诈骗罪。同时,也要考虑犯罪竞合问题,在从一重罪处罚的原则下,妥当解决诈骗罪与招摇撞骗罪、信用卡诈骗罪等同类犯罪的区分,诈骗罪与扰乱无线电通讯管理秩序罪、侵犯公民个人信息罪与掩饰、隐瞒犯罪所得、犯罪所得收益罪等关联(行为方式)犯罪的区分,诈骗罪与拒不履行网络安全管理义务、非法利用信息网络罪、帮助信息网络犯罪活动罪等纯正网络犯罪的区分。电信网络诈骗往往表现为共同犯罪或高级的犯罪集团,既要严格掌握共同犯罪的成立条件以及具体形态,也要依照规定解决共同犯罪分子的刑事责任承担问题,准确体现从严打击精神。对于电信网络诈骗中的非法占有目的、共犯的意思联络、关联犯罪的明知等认定问题,要遵循主客观相统一理念,由客观证明主观,优化证明方法,合理运用推定制度。

The problem of telecommunication network fraud in China's Mainland has intensified.The'Xu Yuyu'case has aroused widespread concern in the society,and it has become a consensus to crack down on telecommunication network fraud.Regarding its conviction,it is usually suspected of constituting the crime of fraud for illegal acquisition of property is a criminal purpose.We must also consider the criminal co-opetition,according to the principle of one crime by more serious punishment,we should properly resolve the distinction between fraud,swindling,and credit card fraud,the distinction between fraud,radio communication management order crime,infringement of citizens’personal information crime and the crimes related to concealing the proceed,the distinction between fraud and cybercrime such as refusal to perform cybersecurity management obligations,illegal use of information networks,and help with information network criminal activities.Telecommunications network fraud often manifests as a joint crime or a high-level criminal group.It is necessary to strictly grasp the conditions for the establishment of joint crimes and specific forms,and also to solve the problem of criminal responsibility of the joint criminals in accordance with the provisions,and accurately reflect the spirit of severely cracking down.For the identification problem in telecommunication network fraud such as the purpose of illegal possession、contact of intention、knowledge issue of criminal intention,we must follow the concept of subjective and objective unity,objectively prove subjective,optimize the proof method,and rationally apply presumption system.
