中国特色社会主义新时代是中国民法典的历史方位和时代背景。新时代的历史方位决定了我们比以往任何时候都更加需要一部具有中国特色和世界典范的中国民法典。新时代社会主要矛盾的深刻变化和人民对民主法治、公平正义、人权保障、产权保护、生态文明、社会和谐的热切期待,决定了中国民法典的时代精神,即坚持以人民为中心、以权利为本位、以法理为依归、以宪法为统领、以科学为支撑。

The modern era of socialism with Chinese character sets the stage of formulating the Civil Code of the P.R.of China,as well as positioning its historic development and endowing its contemporary traits.Against this backdrop,China is in an urgent and unprecedented need of a Civil Code reflecting not only Chinese characteristics but also international standard.The profound changes in the main social contradiction and the keen expectation of Chinese people on democracy,rule of law,social justice,protection of human rights,respect for property rights,ecological civilization,social harmony,determines that the coming Civil Code of the P.R.of China shall stick to several fundamental principles such as people-centered,rights-based,ratiojuris-justified,constitution-guided,and science-supported.
