我国金融机构破产制度的反思与重构

Reflection and Reconstruction on the Legislation of Financial Bankruptcy in China

金融机构破产制度对于防范系统性金融风险、保护金融消费者、维护金融市场信用有着重要意义。我国现有的金融机构破产制度在价值理念、体系构造、立法技术等方面存在较多缺陷。全球金融危机后,美英日等发达国家高度重视金融机构破产的制度建设,我国应有所借鉴,具体的改革路径为:重塑现代性的制度理念,重构多层次的立法体系,重建科学化的规范设计。

The rules for bankruptcy of financial institution play an important role in preventing systemic financial risks,protection of financial consumers and maintenance of financial market credit.In China,the existing legal framework on the bankruptcy of financial institutions still owns some drawback,such as in the aspect of legislative value,system structure,lawmaking technique and so on.After the global financial crisis,the administration of America,Britain,Japan and other countries have attached importance to the reconstruction of the legal framework of financial institutional bankruptcy.China should learn from these countries reform experience,namely we should restore the idea of modernity,and the multi-level legislative system and scientific design of the rules for financial institution bankruptcy.
