高职教育顶岗实习的学生权益保障研究

高职学生顶岗实习工作中的合法权益由谁承担往往发生争议,这是因为实习学生的身份何以定位造成。目前,实习学生的合法权益发生侵害一般不适用《劳动合同法》、《工伤保险条例》等劳动类法律法规,我们可以适用地方性法规,例《广东省高等学校学生实习与毕业生就业见习条例》,但高职学校实习如何管理制度化、法律法规完如何善等方面的改善都有利于保障学生的权益。
