摘要
高职学生顶岗实习工作中的合法权益由谁承担往往发生争议,这是因为实习学生的身份何以定位造成。目前,实习学生的合法权益发生侵害一般不适用《劳动合同法》、《工伤保险条例》等劳动类法律法规,我们可以适用地方性法规,例《广东省高等学校学生实习与毕业生就业见习条例》,但高职学校实习如何管理制度化、法律法规完如何善等方面的改善都有利于保障学生的权益。
Who are responsible for vocational students' legitimate rights and interests during internship often causes dispute, this is because the intern students' identity is difficult to locate. At present, the legitimate rights and interests of students intern are not protected by the "labor contract law", "byelaw of inductrial injury insurance" and other laws and regulations, we can apply to local rules and regulations, students of institutions of higher learning in Guangdong province and practice trainee graduates employment ordinance for example. But how to institutional manage higher vocational school intern students, how to perfect the laws and regulations to protect the rights of students.
