网络虚拟财产的法律保护研究

随着社会的发展和科技的进步,互联网逐步兴盛并成日益发展成为独立的信息产业。在日趋的普及之下,互联网逐步渗透进入社会生活的方方面面,通过网络交易形成了新的经济体系,促使个体权利从现实向虚拟延伸,虚拟财产由此应运而生。但由于立法的滞后,我国有关虚拟财产的法律规制和法律保护仍处于空白,与虚拟财产的发展现状不相适应。本文从虚拟财产的概述入手,针对虚拟财产的法律保护现状进行分析,阐述当前对虚拟财产进行法律保护的必要性,进一步提出虚拟财产法律保护的立法建议,以期为弥补现行法律空白,规范对虚拟财产的管理和保护提出合理的借鉴。

With the development of society and the progress of science and technology, Internet gradually rises, and become independent information industry. Under the increasingly popularization of Internet penetration in social life, step by step through the network transaction form a new economic system, encourage individual rights from the extension to the virtual reality, virtual property which arises at the historic moment. But due to the lag of legislation, regulation and legal protection for virtual property laws is still in the blank, and were not adapted to the development of virtual property. From the overview of virtual property, this paper aimed at analyzing the present situation and problems of the legal protection of virtual property, this paper present the necessity of legal protection of virtual property, and further puts forward the legal protection of virtual property legislation Suggestions, in order to make up the existing law blank, standardize the management of the virtual property and the protection of reasonable reference is put forward.
