无固定期限劳动合同相关问题探析

摘要 《劳动合同法》的颁布,在制度设计上,平衡合同双方当事人的权益,但更多的人都认为本法更多的保护了劳动者的权益,对用人单位的限制性条款较多。不可否认,公权力干预劳资关系,有利于劳动者的弱势地位的提高,但大家对本法的认识还存在一定的误区,特别是无固定期限劳动合同制度,本文从该制度的立法意义出发,对现实生活中经常面临的几个问题谈谈自己的看法。 The promulgation of the "labor contract law", in the system design, balance the rights and interests of contract parties, but more people think this more to protect the rights and interests of labourers, the unit of choose and employ persons more restrictive terms. There is no denying the fact that the public power intervention in labor relations, which is beneficial to improve the weak position of laborer, but everyone know there are some misunderstandings of this law, the non-fixed term labor contract system, in particular, in this paper, starting from the meaning of the legislation of the system, in real life often face a few questions about his own views.
