我国商业秘密中的竞业禁止立法现状及其完善措施

随着改革开放的不断深入发展,我国的经济取得了长足进步,经济制度也逐渐由计划经济向市场经济转变,这对企业来说是一把双刃剑,一方面促进了企业经济的快速发展,另一方面,也给企业的发展带来挑战,市场竞争日益激烈。在信息化时代,信息成为了企业无形的财富,拥有的绝密的信息就比其他企业占得了先机。在这种情况下,企业对信息采取保护措施,使之成为自己的商业机密。本论文就我国商业秘密中的竞业禁止立法现状及不足进行分析,并提出相应的对策。

With the continuous deepening of reform and opening up, China's economy made great progress, economic system gradualy from the planned economy steering market economy, to the enterprise, this is a double-edged sword, on the one hand, promote the rapid development of enterprise economy, on the other hand, bring challenges to the enterprise development, market competition is becoming increasingly fierce. In the information age, information has become the intangible asset of enterprises, with the top secret information had accounted for the initiative. In this case, the enterprise should take measures to protect the information, so that it becomes its own business secrets. The paper analyzes the present situation and the insufficiency of competition law banning in China's commercial secret, and puts forward some corresponding countermeasures.
