The legal value and application of the “Harboring Relatives” system ——In the perspective of building “Rule of law in China”

在建设社会主义法治中国进过程中,我们必须很好的吸收可以在和谐社会建设中发挥积极作用的传统做法与制度。因此,对于在我国存在两千多年的"亲亲相隐"制度,我们不能加以全盘否定。相反,在法治进程中我们应该认识到该制度在对人伦亲情、社会和谐的积极作用,实现法治与情理的统一。

In the process of building a socialist country ruled by law, we must absorb the traditional practices and systems which can play a positive role in the construction of a harmonious society. Therefore, in our country there are more than two thousand years of 'Harboring Relatives' system, we can not negative it completely. On the contrary, in the process of the rule of law we should recognize that the system in positive role on human relations and family and social harmony, to achieve the unity of rule of law and reason.
