自然人在很长时间内下落不明,其在住所地的民事法律关系处于不确定的状态。为了保护自然人和相对人的法律利益,使社会秩序不因自然人下落不明而混乱。我国民法确立了宣告死亡制度。其中包括宣告死亡的申请条件、程序、法律后果及宣告死亡的撤销等。但是由于相关的法律规定和司法解释还不够完善,尤其是对于宣告死亡人异地结婚的法律效力并没有明确规定,这使得被宣告死亡人与生存配偶的利益不能得到有效保护,本文即对宣告死亡人异地结婚的效力进行探究。
