摘要
依据《商标法》,王老吉案中商标必然是属于广药集团所有,与其相对应的商标所承载的商誉也就归属于广药。但是从广药与加多宝公司对该商标的投入比对,得出上述的结论又显得极不合理。因此本文认为后发商誉的归属问题可以借鉴添附制度,依照对商标投入贡献比例,公平分配后发商誉。
According to the 'trademark law', case of Wang-lao-ji, trademarks belong to Guangzhou Pharmaceutical Group, so does the goodwill the trademark bearing. But from the comparison of investment in trademark of Guangzhou Pharmaceutical Group and Jia-duo-bao company, the above conclusion is extremely unreasonable. Therefore this paper considers post goodwill attribution can learn from the accession system, according to the proportional contribution of trademark, fair distribution post goodwill.
