金融法视角下的余额宝法律规制研究

随着互联网技术的飞速发展和金融业的不断扩大,新兴的互联网金融得到了突飞猛进的发展。近年来,互联网金融中出现了很多的理财收益的APP,其中最具有代表性的当属马云创设的支付宝中的余额宝,其适用范围已经在全国甚至是全世界普及开来。虽然余额宝已经得到了较为广泛的应用,但是国内外的很多人士对余额宝仍然有很大的异议。比较正式的关于余额宝的研究目前还处于初级阶段。值得注意的是余额宝的讨论已经上升到了政府的层面,在两会期间互联网金融已经被纳入了政府报告中来。为了加强对互联网金融业的研究力度,本文以余额宝为例,首先分析了余额宝进行法制监管的重要意义,然后总结了余额宝作为一种理财工具目前所具有的风险,然后从金融法视角下对余额宝的法律监管问题提出了合理化的建议。
