摘要
《公司法》解释三第26、28条直接将植根于物权土壤的善意取得制度以参照适用的方式移植于与物权存在着较大差异的股权,其合理性与可行性值得进行深入探讨分析,也可以为我国股权善意取得制度在理论与司法适用方面提供了进一步完善和发展的空间。
Explain of China Company law three 26,and article 28 are rooted in the real right are directly related to the soil in good faith system by reference to the applicable transplantation in rights,the exercise of the aspects there are big differences in equity and property rights,its rationality and feasibility should be in-depth analysis.
