婚内侵权损害赔偿制度研究

家庭是社会的基础,婚姻则是家庭的基石。婚姻的稳定,关乎着家庭与社会的和谐。然而近年来,家暴、婚内虐待等问题却愈演愈烈,给婚姻家庭和社会的和谐蒙上了一层阴影。且更为严峻的是,各国在婚内侵权领域的相关立法却几近空白。因为缺乏法律的强制力和保护力,受害者的权利仅靠道德和舆论的力量无法得到保障,也由此造成了一定程度的不良影响。因此,有必要通过立法建立健全婚内侵权赔偿制度,以更好地保障婚姻生活的幸福安定、规范夫妻双方的权利义务,填补法律上的这一漏洞,进而促进国家和社会的稳定。

Family is the foundation of the society while the marriage is the foundation of the family.The stability of the marriage is conducive to the family and social harmony.In recent years,the growing martial problems have gradually become the negative factors which seriously impact on the social life.What's worse,there is still a blank about the provisions of the tort compensation during the marriage in different countries' laws.Only depending on the moral and the force of public opinion,the victim's rights cannot be guaranteed.Therefore,it is necessary to establish and perfect the system of marital tort compensation to better safeguard the stability and happiness of marriage life,the rights and obUgations of both sides of husband and wife.Meanwhile,this will be conducive to fill the gap in the law and then promote the stability of the country and society.
