校园伤害事故民事法律问题探讨

近年来,校园伤害事件日益增多,尽管从法律上和制度上都有相关的处理办法,但仍存在诸多缺陷。法律的任务是对学校的责任作出适当的界定,以达到监督学校与鼓励学生的独立性之间的平衡。而彻底解决校园伤害事故赔偿问题,必须在坚持由学校承担过错侵权责任的基础上,积极建立责任保险和社会保障制度,共同分担填补损害的任务。同时还要加强对校园安全工作的管理,从源头上减少校园伤害。本文从国内外对校园伤害事故引发的民事法律问题的研究现状以及处理办法方面进行论述,分析减少和妥善处理校园伤害民事赔偿问题的相关对策,希望能够为增强校园伤害处理能力,减少事故发生提供有益帮助。

In recent years, the campus injury incidents are increasing, although there are relevant legal and institutional measures, but there are still many defects. The task of law is to define the responsibility of the school in order to balance the supervision of the school and the independence of the students. And to solve the problem of compensation for campus injury accident, we must adhere to the responsibility of tort liability on the basis of the school, and actively establish liability insurance and social security system, to share the task of filling the damage. At the same time, we must strengthen the management of campus safety, reduce the damage from the source. This paper analyzes the research status quo of civil legal problems at home and abroad on campus injury accident, as well as the solution to reduce the relevant countermeasures properly handle the problem of civil compensation of campus injury, hope to be able to enhance the campus injury processing ability, provide the beneficial help to reduce accidents.
