The Attempting Discussion of Animal Tort

我国《侵权责任法》确立了饲养动物侵权的无过错责任和动物园动物侵权的过错推定责任。然而现代社会纷繁复杂的情况却不能完全纳入其中。尤其是动物园开放或半开放的野生动物侵权责任适用。本文从动物侵权的构成要件、归责原则等方面来分析动物侵权责任问题。
