论不得强迫自证其罪与如实供述义务

The privilege against self incrimination and the obligation of truthful statement

新修改的《刑事诉讼法》第50条中增加规定"不得强迫任何人证实自己有罪。"但是,第118条又保留了犯罪嫌疑人应当如实回答的义务,这样的规定导致"不得强迫任何人证实自己有罪"条款很难得到落实。这两者在一定程度上是存在冲突的,但是我国现阶段的国情又不能彻底废除如实供述义务,因此我们应该寻求协调二者冲突的方法。

The new amendment to the Code of Criminal Procedure, Article 50, provides that 'no one shall be compelled to prove that he is guilty'. However, article 118 of the same law retains the obligation that the suspect should respond truthfully, which results in the difficult to implement the article 50. To some extent, these two articles are in conflict with each other,but in consideration of our country's current situation,it's not suitable to abolish the obligation of truthful confession completely. So what we should do is to seek any possible means to coordinate the conflict between these two articles.
