警察盘查权的法律控制研究

警察盘查权是人民警察维护社会治安的一项重要的职权,本文针对我国现有的法律体系下行使警察盘查权所存在的诸多问题,提出要严格限制盘查的对象、理由、时间和继续盘查的地点;要将盘查纳入法律监督范围;要注重加强人权教育,全面提高警察素质;要在打击违法犯罪、维护社会稳定和保障公民人权方面寻找最佳结合点。

The right of police investigation is an important authority of the People's Police to maintain social order. The author puts forward the problems, the reasons, the time and the continuation of the interrogation of the counterfeiting of the police in the existing legal system. Inventory should be included in the scope of legal supervision; to focus on strengthening human rights education, and comprehensively improve the quality of the police; to combat crime, maintain social stability and protect the human rights of citizens to find the best combination.
