论善意取得制度的完善

The perfection of bona fide acquisition system

善意取得制度是我国法学界一个重点的研究命题,近些年来一直受到学者们的广泛关注。2015年我国《物权法》司法解释(一)的颁布,多项条文对善意取得制度进行了规定,善意取得制度在我国得以进一步的细化。然而我国善意取得制度在遗失物、盗赃物适用方面存在的问题以及认定标准上存在的不足,依然需要我们予以讨论和完善。

The system of bona fide acquisition is one of the most important research topics in the legal circle of China.It has been paid close attention to by scholars in recent years.In 2015 China's 'property law' judicial interpretation(a) issued a number of provisions system of bona fide acquisition,bona fide acquisition system can be further refined in China.However,there are some problems in the system of bona fide acquisition in our country,and the standard is inadequate for the lost property,stolen goods,still needs us to discuss and perfect.
