随着当前社会离婚率的逐步上升,对于夫妻离婚后的财产分配方式也越来越受重视。在新出台的《婚姻法司法解释(三)》中虽然对婚后个人财产收益归属作出了相关规定,但是仍然不免有诸多法律适用上的问题亟待解决,本文将对此进行探析。

With the gradual increase of the social divorce rate,more and more attention has been paid to the distribution of property after divorce.In the introduction of the new 'marriage law judicial interpretation(three)' although make the relevant provisions on the marriage of personal property ownership,but it still has many problems to be solved on the application of the law,this thesis will carry on.
