夫妻忠实义务的考析

本文对当前社会夫妻忠实义务的定义、具体内容、违反夫妻忠实义务的表现进行分析,从而明确违反夫妻忠实义务的内涵,有条件的承认夫妻忠实协议的法律效力,承认在夫妻婚姻关系存续期间,同性出轨及精神出轨同样属于违反夫妻忠实义务,并对违反夫妻忠实义务的行为提出相应的解决措施及立法建议。

This thesis analyzes the definition,concrete content,manifestation that violate the obligation,of fidelity obligation of couple so as to make clear about the connotation of it.The force of law of the loyalty agreement of couple should be admitted.And it should be recognized that in the period in which the couple are under contract of marriage,soul infidelity and same sex infidelity violate the fidelity obligation of couple equally.This thesis also puts forward the solutions and legislative proposals towards the behaviors of violation of couple's fidelity obligation.
