摘要
《担保法》的第49条和《物权法》的第191条以及《担保法司法解释》中第67条在不动产抵押物转让的规则上是一脉相承,并不冲突的。在抵押权人、抵押人和受让人三者利益的平衡上体现的是自由转让说的内涵。在抵押权落实后,作为权利主体的抵押人仍拥有支配抵押物的权利,这是对抵押人利益维护的重要途径与方式,不动产抵押权登记制度保障受让人的权利,抵押权人对抵押物的支配与否,不会影响合同的正常运转。本文以探讨不动产抵押物转让的发展现状为出发点,分别从《物权法》第191条与《担保法》第49条、《担保法司法解释》第67条的解释展开论述,对不动产抵押物转让的规则进行了重点探讨,并总结了研究不动产抵押物转让的规则-结合《物权法》第191条之规定的重要意义,以完成本篇论文的研究,进而不断推动我国不动产抵押物转让的稳步合理发展。
The forty-ninth articles of the guaranty law and the 191 st articles of the property law and the sixty-seventh articles of the judicial interpretation of the guarantee law are in the same origin and are not in conflict with the rules of the transfer of the mortgaged property. The balance between the three interests of the mortgagee, the mortgagor and the assignee embodies the connotation of the theory of free transfer. In the implementation of the mortgage, as a subject of the right of mortgage people still have dominated the collateral rights, which is the important way to safeguard the interests of the mortgage, real estate mortgage registration system to protect the rights of the assignee, the mortgagee to dispose of the collateral or not, will not affect the normal operation of the contract. This paper focuses on the development status of chattel mortgage transfer as a starting point, respectively, from the interpretation of the 191 st articles of the property law and the forty-ninth articles of the guaranty law and the sixty-seventh articles of the judicial interpretation of the guarantee law discusses, transfer of real estate collateral rules are discussed, and summarized the research real estate collateral transfer rules with < important law > 191 st provisions, to complete the research of this thesis, and then continues to promote China's real estate collateral transfer steady and reasonable development.
