《民法总则(草案)》债权规定的相关问题及修改建议

第十二届全国人大会议第一次对《民法总则(草案)》进行审议,审议结果进行了公示,以让公民对其提出建议或意见。在《民法总则(草案)》第五章的"民事权利"中对债权问题做出了相关规定,对目前使用的债权规定进行了一些改进,但是随之而来的也带来了很多新问题。首先无因管理和不当得利放置的位置不是很恰当;同时在对债权的相关内容上存在不合理的设置,条文规定的债因也不够具体,基于此问题的基础,本文分析了《民法总则(草案)》关于民事权利中债权的相关规定和条文内容,提出了关于债权的修改建议和方案,为进一步的完善《民法总则(草案)》中民事权利有关债权内容的相关规定提供一些参考。

For the first time, the Twelfth National People's Congress held a review of the general principles of the civil law(Draft), and the results of the examination were publicized to allow citizens to make suggestions or opinions on them.
