论我国设立让与担保制度的可行性——以让与担保与抵押制度为视角

让与担保作为一种非典型担保制度,因其兼顾"让与"的债权属性和"担保"的物权属性的双重性格,使得让与担保制度在我国的设立存有颇多争议。争议的问题之一就是我国设立让与担保制度的可行性在哪里?本文选取了其中比较有争议的一点即让与担保与我国现行抵押制度的区别来对我国设立让与担保制度的可行性进行分析,以期为今后我国设立让与担保制度扫清理论上的障碍。
