第三人撤销之诉诉权滥用的识别及规制

Legal Regulation on the Abuse of the Third Partly Opposition Proceeding

基于2012年《民事诉讼法》中所新增设的第三人撤销之诉制度,阐述了导致第三人撤销之诉诉权滥用的主要因素,并以此来寻找出第三人撤销之诉诉权滥用的规制方法,即强化法官识别力,确立第三人撤销之诉侵权损害赔偿责任制度以及建立诉讼通知制度。

Based on the third partly opposition proceeding system of Chinese civil proceedings in 2012, the main factors which cause the abuse of the third partly opposition proceeding are expounded. According to these factors, the corresponding regulation methods are proposed, which are strengthening judge's capacity of discernment, establishing the system of tort liability and compensation for damages caused by the abuse of the third partly opposition proceeding and building the proceeding notification system.
