A Study on the Writ of Procuratorial Suggestions

检察建议无疑是检察机关法律监督的重要形式之一,但检察建议自身面临着法律依据不足、法律效力不强、法律程序不明等现实问题,面对这些问题如何立足于现有的法律制度框架,最大限度的发挥检察建议的效力,实现检察机关法律监督的职能定位,成为本文研究的重点。

The procuratorial suggestion is undoubtedly one of the important forms of legal supervision of the procuratorial organs, procuratorial suggestions but itself is facing the lack of legal basis, the legal effect is not strong, unclear legal procedures and other practical problems, how to face these problems based on the framework of the existing legal system, to maximize the effectiveness of prosecutorial advice and legal supervision of procuratorial functions to achieve authorities, become the focus of this paper.
