论监狱法律援助面临的困境及措施

On the Difficulties and Measures Faced by Legal Aid in Prisons

监狱之中法律援助的有效开展,不仅是对国际法义务地履行和宪法原则地落实,更是对弱势群体的扶助,公民基本权利需要的保障。同时,还是实现司法效率与公正的具体要求,是法律特殊属性使然,既有助于教育改造质量地提高,还使监狱的稳定、安全得以维护。但是,就目前我国监狱总体情况而言,对于服刑人员所提供的法律援助仍不容乐观,面临着一些困境。本文,首先对我国法律援助制度的发展历程进行了回顾,然后就当前监狱法律援助工作遇到的一些困境,提出相应的解决措施,以期推动监狱法律援助事业取得进一步的发展。

The effective development of prison legal aid, not only is the implementation of international law obligation to fulfill and constitutional principle, is to help vulnerable groups, the basic rights of citizens need protection. At the same time, or to achieve specific requirements of judicial efficiency and justice, is the legal attribute of special nature, not only contribute to the education reform improve the quality of the prison, stability, security is maintained. However, as far as the overall situation of our country's prisons is concerned, the legal aid provided by the prisoners is still not optimistic, and it faces some difficulties. Firstly, this paper reviews the development of the legal aid system of our country. Then, in view of some difficulties encountered in the current prison legal aid work, the author puts forward the corresponding solutions in order to promote the further development of the prison legal aid cause.
