中国反恐立法新格局的构建研究

A Study on the Construction of a New Pattern of Anti-Terrorism Legislation in China

恐怖主义作为全球各国的共同敌人,打击恐怖主义离不开法律支撑,新常态下反恐立法格局的重构已经成为我国解决暴恐问题的关键。本文在简要分析我国反恐立法现状基础上,结合实际探讨了我国反恐立法中存在的问题,包括界定混淆、职能混同、行司失衔等,并从价值诉求、模式选择、内容架构、立法衔接等方面入手,重点探讨了中国反恐立法新格局的构建路径,以期为我国反恐立法突破提供新视角。

Terrorism as the common enemy of all countries in the world, the fight against terrorism can not be separated from the legal support. The reconstruction of anti-terrorism legislation pattern under the new normal has become the key to solve the problem of violent terror in our country. Based on the brief analysis of the current situation of anti-terrorism legislation in China, this paper discusses the existing problems in our anti-terrorism legislation combined with the actual situation. Including the definition of confusion, functional confusion, loss of rank and so on, and from the value demands, mode selection, content structure, legislative convergence and other aspects, the focus on the construction of a new pattern of anti-terrorist legislation in China. In order to provide a new perspective for our country's anti-terrorism legislation breakthrough.
