网络谣言刑法治理的基本立场探究

随着我国互联网的发展,网络给人们的生活和工作带来了很大的方便,同样也带了很大的困扰。在网络上人们可以随意发表自己的意见看法,而不用像现实中顾忌太多,正是这种毫无顾忌的言论所造成的网络谣言给国家,社会以及个人都带来了非常严重的名誉和利益损失。本文首先对网络谣言,网络谣言所犯的刑法罪名以及我国关于网络谣言刑法治理的现状进行概况分析,探讨我国关于网络谣言刑法治理的基本立场。

With the development of Internet in our country, the network brings great convenience to people's life and work, and also brings great troubles.On the Internet, people can express their opinions at will, rather than having too many scruples in reality. It is this kind of unscrupulous talk that causes online rumors to the country.The society as well as the individual has brought the extremely serious reputation and the benefit loss.In this paper, the author firstly analyzes the network rumors, the criminal charges committed by the network rumors and the current situation of the criminal law governance of the network rumors in our country, and probes into the basic stand of the criminal law governance of the network rumors in our country.
