交强险中精神损害抚慰金赔偿问题研究

Study on Compensation for Spiritual Damages in Traffic Insurance

机动车交强险中的精神损害抚慰金赔偿问题,是司法实务中引发争议最多领域之一,在机动车同时投保交强险和商业三责险的情况下,由于商业三责险不赔偿精神损害抚慰金,考虑到交强险立法理念以及交强险和商业三责险的关系,交强险中精神损害抚慰金数额的确定和赔偿顺序问题,关系到被侵权人最终的获赔数额以及被保险人的实际利益。保险法学者和司法实务界对此有很多不同的观点,笔者通过相关争议和学说进行分析,来回答两个重要的问题:(1)精神损害抚慰金是否应该按比例分摊;(2)在交强险中,精神损害抚慰金是否应该优先赔付。

The compensation for mental damage in motor vehicle traffic insurance is one of the most controversial areas in judicial practice. Since the commercial triple liability insurance does not compensate for the compensation for mental damage, considering the legislative concept of the traffic insurance and the relationship between the commercial insurance and the commercial liability insurance, the determination and compensation order of the amount of the compensation for the mental damage in the traffic insurance are discussed. It is related to the amount of indemnity of the infringee and the actual interest of the insured. The scholars of insurance law and judicial practice have a lot of different views on this. The author analyzes the relevant disputes and theories to answer two important questions:(1) whether the compensation for mental injury should be apportioned proportionately;(2) in the traffic insurance, whether the compensation for moral damage should be paid first.
