我国应对气候变化的法律制度研究

Research on China's Legal System to Deal with Climate Change

气候变化问题是一个关乎全球生存环境的重大问题,伴随着经济的发展、不洁能源的使用,气候变化问题也变得越来越严峻。本文第一部分,是从我国的应对立场及立法的现实情况出发进行探讨和研究;第二部分,结合我国现实情况对当前法律制度的不足进行分析;第三部分,通过欧盟、美国以及日本的相关立法和制度的分析,总结了对我国的四方面启示;第四部分,从指导思想、法律体系完善和健全具体制度三个方面为我国气候变化法律制度的完善提供了建议。

Climate change is a major problem related to the global living environment. With the development of economy and the use of dirty energy, the problem of climate change is becoming more and more serious. The first part of this paper is to discuss and study from the standpoint of our country and the reality of legislation;the second part is to analyze the deficiency of the current legal system according to the reality of our country;the third part, through the European Union, The analysis of the relevant legislation and system of the United States and Japan summarizes the enlightenment to our country from four aspects;part four, from the guiding ideology, The perfection of the legal system and the perfection of the specific system provide suggestions for the perfection of the legal system of climate change in China.
