Tort Liability Determination of Electric Vehicle Traffic Accidents

本文旨在先对电动自行车的属性进行明晰,然后对市面上存在的三种电动车(达标电动车、超速电动车、超重电动车)在发生交通事故时应如何认定侵权责任,进行分情况讨论,最后在针对电动自行车的侵权认定所面临的困境,提出解决方法。

The purpose of this paper is to clarify the attributes of electric bicycles, and then discuss how to determine the infringement liability of three kinds of electric vehicles(up to standard electric vehicles, speeding electric vehicles, and overweight electric vehicles) in the event of a traffic accident. Finally, the solution to the dilemma faced by the identification of electric bikes for infringement was put forward.
