摘要
我国现行《著作权法》规定了录音制品法定许可制度,但从2012年修改草案第一稿对该制度做出了一定修改,到2014年送审稿中完全删除该制度,无论是在音乐产业界还是在学术界都引发了激烈讨论,针对该制度的去留问题至今仍存有不同观点。本文将从录音制品法定许可制度的立法背景以及价值取向等角度出发,结合我国当前现行著作权法中对于该制度规定存在的一些问题进行讨论,并对该制度的去留问题进行探讨,最终提出符合我国国情的观点建议,期望可以为我国录音制品法定许可制度的发展完善有所裨益。
The current Copyright Law of China stipulates a statutory license system for sound recordings, but the first draft of the revised draft in2012 has made some changes to the system and completely deleted the system in the submission for review in 2014. Both in the music industry and in the academic circles have aroused heated discussions on the issue of whether the system will remain or not. There are still different views. From the legislative background and value orientation of the statutory license system for sound recordings, this paper discusses some problems in the current copyright law of our country, and discusses the problem of the system’s leaving and leaving. Finally, it puts forward some suggestions which are in line with the national conditions of our country. The development and improvement of the statutory licensing system for recording products in China is beneficial.
