摘要
作为国有档案的一种特殊类型,人事档案是组织考核选拔干部的重要依据和当事人信用情况的基本凭证。虽然我国三十多年的档案法治进程中,逐渐形成了比较完备的立法体系。但人事档案违法现象仍然屡禁不止,造成的后果也越来越严重。因此,分析人事档案违法行为,追究相关人员的法律责任,对遏制人事档案违法行为、保护档案当事人权益不受侵犯、实现依法治档、建设法治中国都具有积极的意义。
As a special type of state-owed archives, personnel archives are the important basis for the organization department to select and appointment cadres and the basic evidence of the credit status of the parties. Though China has gradually formed a relatively complete legislative system in the process of archival rule of law in more than 30 years. However, the illegal phenomenon of personnel archives is still repeatedly forbidden, and resulting in more and more serious consequences. Therefore, it is of positive significance to analyze the illegal behavior of personnel file and investigate the legal responsibility of the relevant personnel, which is of great significance to curb the illegal behavior of personnel file, protect the rights and interests of the archival parties from being infringed, realize the administration of archives according to law, and build China under the rule of law.
